This Privacy Policy outlines our online collection, use and disclosure of data. This Privacy Policy applies to all iWitnessUpload Pty Ltd Services, including but not limited to the Websites, Apps or any other content, product, service or feature available through the Websites or the Apps owned and operated by or otherwise under the control of iWitnessUpload Pty Ltd.


This Privacy Policy forms part of the Terms Of Use Agreement  (collectively the “Terms”) and should be read in conjunction with those Terms. Any terms not defined in this Privacy Policy are defined in the Terms and Conditions of Use. Use of third party products, services, or processes, including without limitation our clients using our technology, are subject to their own privacy policies and should also be reviewed before use.


Notification of changes to this Privacy Policy:

We may revise or update this Agreement by posting an amended version through the Service and making you aware of the revisions. Your use of the Service following an update to this Agreement (or other acceptance method) is considered acceptance of the updated Agreement. If you do not accept the changes, you must stop using the Service.


Personal Information:

Personal information refers to information about an identifiable individual including, but not limited to, your name, job description, birthday, email address, location data or postal address. You may be asked to provide certain personal information in order to receive information, advice, or Services from us. This information is either manually or electronically stored in our databases. By submitting personal information manually or in electronic form to us and/or by using our Services you give your consent to such information being used by iWitnessUpload Pty Ltd in the manner set out in this Privacy Policy.


Collection And Use Of Personal Information:

Registration: In order to register with us (“Registered Contributor”), you will be required to share your full name and email address, contact number and location with us.  Any further information you provide is completely voluntary. You will have to register in order to upload User Content to the Services, and make full use of the Services. Once you become a Registered Contributor, you may provide additional information to your iWitnessUpload Pty Ltd profile that describes your experience, interests, previous work or any other information. We also collect location data through your device which can be turned off at any time through your device settings. Any information you provide to iWitnessUpload Pty Ltd beyond the minimum that is required for registration is voluntary. Any information you provide at registration or in your personal profile may be used in the manner described in this Privacy Policy.


Account: Once you register, you will have an Account with iWitnessUpload Pty Ltd and a password to access that Account. You must not use another person’s Account without permission and you may not use anyone else’s password. We recommend that you keep your password secure and confidential and you always log out from your Account at the end of a session to prevent other people from accessing your Account without your permission. You are obliged to provide true and accurate information in your public profile and any breach of this may result in provision of the Service to you being suspended.


You are solely responsible for any activity occurring on your Registered User Account.


You can review the personal information you provide to us and make changes to the information you publish, or to the settings for your Account, at any time by logging into your Account on the Website or App. Please be aware that even after your request for change has been processed we may, for a short time, retain residual information about you in the backup and/or archival copies of the database.


Content Submissions: When you upload User Content to the Services we may also collect the following information in order to correctly verify and validate User Content:

location, date and time the image or video was taken and sent to us;

the make and model of the device; whether the User Content has been edited by you;

how many times you have uploaded User Content to our Services; and

whether previous User Content has been validated, deleted or sold by us.


If we make a sale of your User Content, we may also request additional information from you, such as your banking BSB & account number, in order to make a payment to you. The purchasers of your User Content will receive parts of your contact information which may be used for content verification purposes, this will include your full name, email and contact number. Our purchasers agree to keep any personal information received from iWitnessUpload Pty Ltd safe and secure.


Your uploaded User Content and information may be used for marketing and Promotional Purposes, including on the Websites, Apps, or corporate materials of iWitnessUpload Pty Ltd without monetary gain.


Your personal information will never be sold to third parties for marketing.  


Payment Processor: We may use a third-party payment processor (“Stripe”) to bill and remit payments through an online account for use of the Services. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to these Terms. We are not responsible for error by the Payment Processor. We reserve the right to correct any errors or mistakes that it makes even if it has already requested or received payment. Once a broadcaster (purchaser) has made payment to iWitnessUpload or its authorized Payment Processor, the Publisher shall have no further liability for payment to the content uploader.


Communications: We may use your first and last name, email address, and phone number to communicate with you about your Account, User Content, or payments. 


We may also send email communications or newsletters regarding service updates, news, press publications and our Services. You can unsubscribe from any marketing related communication by following the instructions in such communication,


Product Development: the information you provide to IWitnessUpload Pty Ltd is used to help us understand how Users interact with our Services.  We use your information to perform analytics, assess web traffic and user interactions, and strengthen our machine learning and artificial intelligence capabilities. This information allows us to monitor and improve our Services to provide you with the best possible service.

Interactive Services: Our Services may contain interactive areas, including but not limited to discussion forums, blogs, chat rooms, message boards, or other areas in which you or third parties post or store content, messages, comments, materials or other items (“Interactive Services”). In order to participate in these Interactive Services we may request certain personal information such as your name and email address. We may use your comments to monitor and/or improve our Services. Please remember that any information that you provide in these Interactive Services are accessible to all users of the Services, and you should exercise caution when deciding to disclose any personal information about yourself or anyone else.


Contact Us: If you choose to contact us with a comment, suggestion or feedback, we may collect your name, e-mail address, phone number and the comments, suggestions or feedback you provide. We use this information to respond to you and we may retain it to assist you in the future. We also may use your comments, suggestions or feedback to monitor, improve, and/or promote our Services.

We do our utmost to ensure that all reasonable steps are taken to make sure that your data is treated and stored securely.

We cannot guarantee the security of data that you choose to send us electronically; sending such information is entirely at your own risk. In the event iWitnessUpload Pty Ltd becomes aware of a security breach involving your data held by iWitnessUpload Pty Ltd we will notify you in compliance with applicable data protection laws.


Legal: We and our service providers may disclose or share your personal information in order to comply with any legal obligation (including a search warrant, or other legally valid inquiry or order, or to protect the rights, property, or safety of iWitnessUpload Pty Ltd, our customers, or others, or as otherwise required or permitted under applicable law. We may also disclose personal information where necessary for the establishment, exercise or defence of legal claims.


Sale of Business: We may transfer any information we have about you as an asset in connection with a merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of iWitnessUpload Pty Ltd or as part of a corporate reorganization or other change in corporate control.


Third Party Links: On occasion we include links to third parties on our Services that are not operated by us. Where we provide a link it does not mean that we endorse or approve that site’s policy towards visitor privacy. Erase Account or Unsubscribe: If you no longer wish to receive information from us and would like to be removed from our mailing list, or if you are a Registered User and you would like to erase your Account, you can make a request by emailing


Erasing your Account will permanently delete all personal information and User Content Uploaded to the Services. Upon erasure, this information will no longer be accessible or available for distribution or licensing. We will reply to your request as soon as possible, within a reasonable time and subject to any pending payments, and you will be notified when the request is completed.


Children: We will not solicit or knowingly collect personal information from anyone under the age of 16. If you are under 16 years old, you may not use or enter information on the Services, including without limitation, any Interactive Areas of the Websites.


Governing Law: This Privacy Policy forms part of our Terms and as such, any dispute, controversy, proceedings or claim of any nature arising out of or in any way relating to this Privacy Policy, shall be governed by and construed in accordance with the laws of Western Australia, Australia or as otherwise required by applicable law. You and iWitnessUpload Pty Ltd submit any disputes arising out of or in connection with these Terms to the exclusive jurisdiction of the Courts of Australia.
